One step closer to an EU regulation on packaging and packaging waste

On March 4, 2024, negotiators from the Council of the EU and the European Parliament reached a provisional agreement on the upcoming packaging regulation, which aims to reduce packaging waste production and ensure more reuse and recycling.

The provisional agreement text includes the following points of interest for GS1 members:

  • All packaging must be recyclable by 2030. Criteria for design for recycling will be developed and introduced via delegated acts.
  • Businesses selling takeaway food and drinks must allow customers to bring their own containers for cold or hot beverages or prepared food at no extra cost.
  • Ban on the use of "forever chemicals" like PFAS in food contact packaging.
  • A maximum of 50% empty space is allowed in multipack, transport, and e-commerce packaging to minimize unnecessary packaging.

What happens next?

The provisional agreement will now be submitted to the representatives of the member states in the Council (Coreper) and the European Parliament's Committee on the Environment for approval. It must then be formally adopted by both institutions. The plan is for this to happen before the European Parliament elections in June 2024.

At GS1 Denmark, we look forward to studying the final legal text closely, where we will focus in particular on the harmonization of extended producer responsibility for packaging and the potential requirement for digital data carriers on packaging to communicate recyclability.

How to prepare for the upcoming packaging legislation

Although neither EU legislation nor Danish legislation regarding extended producer responsibility for packaging has been finalized, the preliminary drafts provide a good idea of what companies can expect on the packaging front.
