There are new developments on several fronts regarding packaging legislation. In the EU, a new packaging regulation has been approved, and in Denmark, the latest executive order on producer responsibility for packaging, which has been under consultation, has now become law.
We have compiled the most important points from both sets of legislation so you know what you may be subject to, including deadlines. You can also find advice on how to get help.
In Denmark, we finally have a new executive order. It is titled: Executive Order on certain requirements for packaging, producer responsibility for packaging, and other waste collected with packaging waste. It was issued on December 30, 2024, and takes full effect from October 1, 2025, with ongoing reporting. Here is a selection of what you should be aware of now and in the future.
This means that companies that have not yet chosen a collective scheme are required to sign up for one no later than January 14, 2025. Did you report your expected packaging volumes directly to the DPA in 2024 without being signed up for a collective scheme? Then it is time to register your company with the collective scheme that best suits your needs.

You likely remember that last year you had to report your expected packaging volumes for 2024. Now the time has come for companies with producer responsibility to revisit their 2024 packaging data and report how much was actually sold or made available throughout the year. This must be done no later than May 31, 2025.
Do you have your packaging master data ready in your GS1 start kit? Then it is just a matter of updating your figures for sold volumes. And when you are ready to continue working with your packaging data, you can have them transferred to our packaging data system, GS1Trade Packaging.

If your company is not yet registered in the DPA register because it exclusively uses reusable packaging, you must register your company with the DPA no later than February 1, 2025. If you have any questions regarding this, we recommend that you speak with your collective scheme.
If you need to report data for eco-modulation, packaging in the red category will trigger a 35% surcharge. The new EU packaging regulation aims to promote a circular economy through increased requirements for packaging design, reuse, and recycling. The Packaging and Packaging Waste Regulation (PPWR), as it is called, was adopted on December 16, 2024, and will enter into force in mid-2026.
The new rules include requirements for the amount of recycled material in certain types of packaging and mandate that takeaway providers offer reusable packaging as an alternative to single-use packaging. Furthermore, consumers must be better informed through labeling and information regarding the packaging's material and the amount of recycled content.
